A business work permit does not automatically give a spouse permission to work or a child the right documents for every school situation. Since January 21, 2025, family open-work-permit eligibility has been restricted under certain measures; IRCC's current page also contains separate pathways and exceptions. Start with the principal worker's actual category, work and documents, then assess each family member.
A family permission map
- Principal worker
Identify the actual work-permit category, duties and expiry.
- Spouse or partner
Find the correct family-work branch or assess a separate option.
- Child
Check study permission and school admission separately.
- Health and budget
Confirm provincial coverage and plan without uncertain income.
- Family review
Compare each person’s documents and unresolved questions before travel.
This original planning diagram separates questions. It is not an eligibility result or a prediction.
Make a separate status line for every family member
List each person's citizenship, current location, immigration document and intended activity. A spouse's employment plan, a child's school enrolment and a parent's business duties are different decisions. Avoid a single line saying family visa approved when the applications and conditions may differ. Keep the actual document and decision for each person available.
A shared travel date does not mean every family application will have the same answer or duration. Prepare a family calendar showing document expiry dates, proposed travel, school start dates and commitments. Mark what is confirmed separately from what is only proposed. This is a planning tool, not a calculation of anyone's right to work, study or remain in Canada.
Find the correct spouse work-permit branch
IRCC's current family-work page contains several eligibility branches. For the high-skilled-worker measure outside an eligible permanent-residence pathway, IRCC requires a valid work permit or approval letter, plans to live in Canada, and employment in TEER 0 or 1 or a listed TEER 2 or 3 occupation. The principal worker’s permit generally needs at least 16 months remaining when the spouse applies. Other branches have different conditions. IRCC’s eligible permanent-residence pathways include provincial business candidates and Quebec self-employed applicants with an approved CSQ who are seeking permanent residence. For this branch, the principal worker generally needs a valid permit or approval with at least six months remaining, issued because of an application under an eligible economic PR pathway. This is distinct from the high-skilled-worker measure, which generally requires 16 months remaining. Quebec also has a separate spouse measure effective June 5, 2026. Check the current criteria for the exact route; do not apply one branch to every business permit or family member.
Before choosing a family-work strategy, compare the business immigration and work-permit routes; for the entrepreneur category, see our C11 evidence guide. These explain the principal worker’s category and do not decide a spouse’s eligibility.
Record the principal worker's permit category, the work actually performed and the branch being assessed. An ownership title does not establish an occupational classification. Ask which evidence supports the chosen branch and whether any exception is genuinely applicable. A provincial support letter, a PR application or a business plan should not be treated as interchangeable proof of the same family-work entitlement.

Do not assume an owner is automatically in a qualifying occupation
A person may run a business while performing a mixture of management and operational duties. Describe that work accurately before relying on an occupation-based spouse measure. A business registration, the words chief executive or an immigration consultant's shorthand cannot replace an assessment of the actual work and applicable instructions.
Prepare a short duties record and supporting employment or business documents. Show how the person is authorised to do that work. Where the classification remains uncertain, leave it uncertain in the family planning sheet rather than entering a convenient TEER category. The answer must come from the correct legal assessment, not from the family's need for a second income.

If a spouse cannot use this measure, review the alternatives honestly
A spouse who does not meet a family open-work-permit measure may need to consider another work-permit category or a temporary stay without working. Each option has its own requirements. The existence of an alternative application form does not show that the person meets that category, and an application should not be presented as permission already granted.
Build the household budget without assuming unconfirmed employment income. Record which planned activities need work authorisation and obtain advice before starting them. Calling a role unpaid, helping the family business or working informally does not answer the immigration question. Describe the activity itself, including who benefits and how it is organised, rather than choosing a label to avoid the assessment.

Children need a study and school-admission check
IRCC's minor-student instructions distinguish situations by age, location and the parents' circumstances. Children coming from abroad to study for more than six months generally need a study permit, including in many cases when a parent holds a work or study permit. Different rules may apply to children already in Canada with a parent who has a work or study permit. Check the actual circumstances and required documents before travel.
School registration and tuition treatment are separate provincial or board questions. Ask the intended school board which documents it needs for the child and parents. Bring previous school records, identity documents and the family's current immigration documents through an appropriate private channel. Do not interpret a school's willingness to discuss enrolment as an immigration decision or a promise that no fees will apply.

Separate health coverage from immigration permission
Ontario's OHIP page lists several conditions, including residence, physical presence and qualifying status. Certain work-permit holders and family members may qualify, but the business permit alone does not establish that every family member is insured. Have ServiceOntario assess the actual documents under the current provincial rules.
Prepare for any period when coverage is not confirmed. Ask an insurer or health-service provider what a policy or service covers, rather than assuming a work-permit label pays every health cost. Keep evidence of the coverage decision and start date. This guide does not select an insurance product or determine an individual's medical coverage, and it does not treat emergency access as proof of OHIP eligibility.

A family PR plan still requires separate eligibility work
The person operating the business is not automatically the principal applicant for permanent residence. Review both adults' histories, language results and education under an identified program. A spouse's open work permit, where available, is permission to work subject to its conditions; it is not a positive permanent-residence assessment.
Keep the business and family evidence organised together without merging their legal purposes. A new job, a different province or a change in family circumstances may require a fresh assessment. Do not rely on a future nomination or invitation that has not occurred. Use truthful records to compare options, and keep unconfirmed eligibility out of financial and school commitments.
Prepare a family application folder without hiding differences
Use one index for identity and relationship records, then separate tabs for each person's application and intended activity. Note different spellings, renewed passports and changes since earlier forms. Explain discrepancies with supporting records rather than silently using a new version of the family history. A neat folder should make the differences understandable, not erase them.
Keep sensitive details out of a public comment or social-media message. Ask the professional reviewing the family plan which secure channel to use. Bring existing refusals and pending applications as well as favourable documents. Those records can affect the questions that need answering, and withholding them from an adviser makes a careful assessment harder.
A family calendar to complete before booking
This is an original blank worksheet, not a client account or a government checklist. Add truthful facts and mark unresolved points for advice.
| Question | Record to bring | What still needs an answer |
|---|---|---|
| Who plans to work? | Each adult’s permit and actual intended activities. | Which rule authorises the work, and when? |
| Who plans to study? | Child’s documents and school-board requirements. | Is a study permit or another document needed? |
| Which dates differ? | Passport, permit and school calendar. | What happens if one decision or document arrives later? |
| Which health costs are covered? | Provincial decision and any insurance terms. | When does each person’s confirmed coverage begin? |
An original household-budget exercise
Imagine a family planning a move based on two adult incomes. One adult has a proposed business role; the other expects to work immediately after arrival. This is an illustrative planning exercise, not an office file. Prepare one budget using only confirmed lawful income and a second showing the hoped-for income. The gap identifies a financial question, not a reason to assume a spouse qualifies.
Now add school, transport and health costs that still need confirmation. Record the source of every estimate and avoid describing an unconfirmed service as free. Ask the school board about admission documents and ServiceOntario about health eligibility. A correct answer in one area does not resolve the others.
Finally, add a travel contingency: one family member's document may expire earlier or an application may remain undecided. Write who will obtain advice and which commitments can be changed. The purpose is to reduce avoidable assumptions before making arrangements, while leaving immigration decisions to the authorities responsible for them.
Questions about family on a business work permit
Does a C11 or ICT permit automatically let a spouse work?
No. The correct current family-work branch and the principal worker’s actual circumstances must be assessed.
Are all dependent children eligible for a family open work permit?
No. The January 2025 restrictions apply to specified measures; check the exact current branch and any renewal exception rather than using a blanket rule.
Does school enrolment settle immigration permission?
No. Federal permission to study and a school board’s admission or fee assessment are different questions.
What if our health coverage is uncertain?
Ask ServiceOntario to assess the documents and plan for costs until coverage is confirmed. Do not assume a permit automatically covers the whole family.

IRCC: minors studying in Canada
A child’s age, location and parents’ circumstances affect whether a study permit is required. Children coming from abroad for more than six months generally need a permit; different rules may apply to children already in Canada with a parent who has a work or study permit. Federal study permission and provincial school admission or fees are separate questions.
