H&C applications: connect the circumstances to evidence

Canada’s H&C process is discretionary and has strict eligibility limits. Learn how evidence, children’s interests, timing restrictions and removal issues fit together.

A humanitarian and compassionate (H&C) request asks the Minister to consider an exemption or permanent residence in circumstances covered by section 25 of the Immigration and Refugee Protection Act (IRPA). It is discretionary and does not replace an unavailable immigration program or guarantee approval. IRCC says H&C is not a process for assessing persecution, risk to life, or cruel and unusual treatment; those protection questions belong in the applicable refugee or protection process. An H&C submission also does not delay removal. Read IRCC’s H&C overview.

Establishment, a child’s best interests, health and other relevant circumstances must be explained with evidence about the person’s actual situation. An outstanding refugee claim can affect whether an in-Canada H&C request may be examined; IRCC’s guide identifies it as a restriction, and IRPA section 25 sets the statutory limits. Check the complete claim, appeal, PRRA and court history before acting. Any removal notice needs separate urgent advice, because filing H&C does not delay removal.

How does a humanitarian and compassionate application work?

IRPA section 25 provides the statutory framework for H&C consideration. IRCC's Guide 5291 explains who may use the application and important restrictions. Before gathering a large bundle of supportive letters, identify what exemption is being requested and whether the person can use this process. A sympathetic description does not answer an eligibility restriction.

Bring immigration history, prior applications, decisions and current notices to an individual review. Do not withhold an unresolved refugee claim or enforcement communication because it complicates the plan. A careful assessment needs the whole procedural history. This guide explains the evidence questions but cannot determine whether section 25 is available to a particular person.

Check the 12-month bar and the actual exceptions

IRCC’s Guide 5291 describes a 12-month bar after certain rejected, abandoned or withdrawn refugee claims; a withdrawal before the hearing is treated differently. Under IRPA section 25(1.21), the bar does not apply where removal would adversely affect the best interests of a directly affected child, or where removal would expose the person to a risk to life because the relevant country cannot provide adequate health or medical care. These are specific legal tests, not general exceptions for any child or health concern.

A separate five-year restriction can apply to a designated foreign national. The relevant start date depends on the procedural event set out in IRPA section 25(1.01); subsection 25(1.02) also addresses suspension when a person becomes designated while an H&C request is pending. Check the actual designation and decision history against the current statute before calculating either period.

Map the relevant decisions and dates before relying on an exception. Have a qualified professional assess which provision applies and what it requires. Do not assume a new label removes a restriction, and do not withdraw another proceeding based solely on a general article. A choice affecting an active claim or legal right needs individual advice about the consequences.

Explain establishment through the life that actually exists

Establishment is among the factors identified in IRCC's guide. Prepare a factual account of work, study, relationships, community participation and other relevant circumstances. Connect each point to records or people with direct knowledge. The number of letters or years in Canada is not an automatic approval formula.

Ask letter writers to describe what they actually know, how they know it and over what period. Avoid identical promotional letters that make unsupported claims. A short specific account can be easier to assess than a dramatic statement with no factual basis. Do not create employment, volunteering or family responsibilities that did not occur simply because those categories appear in a checklist.

A child’s interests need child-specific evidence

Section 25 directs attention to the best interests of a child directly affected, and the current guide identifies possible considerations such as age, education and health. Describe the particular child's circumstances and the effect of the decision rather than using a generic statement that children are better off in Canada.

Where appropriate, obtain accurate records from people who actually know the child and understand what they are being asked to describe. Keep sensitive details private and avoid unnecessary public disclosure. A child's presence in a family does not determine the application outcome by itself. Individual advice is needed about relevance, evidence and how the child's interests fit the whole assessment.

Read Kanthasamy as a whole-context decision

In Kanthasamy v. Canada, 2015 SCC 61, the Supreme Court majority explained the equitable purpose of section 25 and the need to consider relevant circumstances as a whole. It cautioned against turning guideline hardship adjectives into separate rigid legal thresholds. The decision should not be reduced to a new checklist that guarantees relief when certain facts are present.

For preparation, identify how the circumstances relate to one another. A health issue, family relationship or disruption may be relevant in context, but the weight and legal analysis require professional judgment. This article does not translate one judgment into a predicted result for another person's file. The official decision is linked for the legal reviewer to read alongside the current statute and guidance.

Use health evidence for the question it can actually answer

IRCC's guide includes health among potentially relevant factors. A medical or psychological record should accurately explain the matters within the professional's knowledge. Do not ask a practitioner to guarantee an immigration result or write an opinion outside their expertise. Keep the person's actual care needs and the immigration argument separate.

Discuss consent and secure handling before sharing sensitive records. If a report relies on information supplied by the applicant, preserve the context and any supporting material. A diagnosis should not be invented, exaggerated or reduced to a label used for immigration advantage. Obtain appropriate clinical care for health concerns and individual immigration advice about the evidence needed for the application.

An H&C application does not automatically stop removal or authorise work

Guide 5291 states that submitting an H&C application does not delay removal. A person with an enforcement notice therefore needs separate advice about that situation and any available legal process. Do not assume that paying a fee, receiving an acknowledgement or preparing supportive evidence creates a stay.

Also keep temporary status and permission to work or study on separate lines of the plan. This guide does not determine those rights or supply a processing-time promise. If Federal Court relief is being considered, obtain qualified lawyer advice promptly. An RCIC licence does not authorise court representation, and waiting for H&C preparation should not be assumed to preserve another deadline.

Build an indexed chronology and keep it current

Organise the file around a dated personal history, the exemption requested and the evidence supporting each circumstance. Identify documents already submitted in earlier applications so the new account remains consistent. Record gaps honestly. A well-organised folder makes the evidence easier to locate but does not turn an unresolved legal question into a favourable finding.

Keep copies of submissions and later updates. Where circumstances change, obtain advice about the appropriate way to provide the new information. Do not assume an old letter continues to describe the current situation. The aim is a truthful record that can be assessed over time, with the individual and decision-maker able to understand what each document establishes.

Question Record to bring What still needs an answer
What exemption is requested? Current status and full application history. Does a restriction or exception require legal assessment?
Who is directly affected? Accurate family and relationship records. What is the actual effect on each person?
What does a letter establish? Author, relationship, dates and direct observations. Is the statement within the writer’s knowledge?
What is urgent? Removal notice and other decisions. Does a separate process require prompt lawyer advice?

An original evidence-organising exercise

Imagine a folder containing employment records, a child's school report and a relative's general letter of support. This is a fictional teaching exercise, not a client story or an eligibility finding. Ask what each item actually establishes and what it leaves unanswered. Do not rank the person as a strong or weak applicant based on the number of documents.

Next, connect the records to the circumstances described. Does the relative explain a real relationship and direct knowledge? Does the school record identify a particular child's situation rather than prove every proposed consequence? If a question needs professional evidence, record that need without inventing an answer.

Finally, place the immigration history and any removal notice at the front of the exercise. The availability of supportive evidence does not remove statutory restrictions or enforcement questions. Bring the organised record to individual review, where the legal framework and the person's circumstances can be considered together without a promise of relief.

Questions about h&c applications

Is H&C available whenever another program is closed?

No. It is an exceptional process with restrictions and an individual statutory assessment.

Does having a child guarantee approval or an exception?

No. The particular legal provision and child-specific evidence must be assessed.

Does applying stop removal?

IRCC’s current guide says an H&C application does not delay removal. Obtain separate advice about an enforcement notice.

Is hardship a fixed three-part checklist?

Kanthasamy cautions against rigid guideline thresholds. The relevant circumstances and current law need a whole-context professional assessment.

General information only. Requirements can change and no outcome is guaranteed. IRCC, ESDC, the IRB, provincial authorities or the courts make decisions within their responsibilities.
