Business immigration to Canada in 2026: current status

Business immigration to Canada in 2026 needs a current intake check before a business plan: IRCC’s Start-Up Visa page says new applications are paused from June 30, 2026, following Ministerial Instructions 90 effective January 1, 2026, and the federal Self-Employed Persons Program remains paused until further notice. Certain temporary work-permit categories still have application instructions, but a business purchase or work permit does not establish permanent residence eligibility.

An unoccupied Canadian commercial street with plain brick storefronts.

Business immigration to Canada requires a named route and a separate check of its current intake. New federal Start-up Visa intake is paused following the June 30, 2026 filing deadline, and the federal Self-Employed Persons Program remains paused under Ministerial Instructions90, effective January1,2026; temporary work permission and provincial nomination each have their own rules.

Original decision chart

From a business idea to a defensible next step

  1. Name the actual goal

Write down whether you want a short business visit, permission to work or permanent residence. Keep these as separate questions.

  2. Check the current intake

Open the responsible government page and record its date. If intake is paused, stop treating an old eligibility list as an application invitation.

  3. Match the legal category

Identify which rules fit the proposed work and company relationship. An investment amount or job title alone does not select a category.

  4. Map evidence to the rule

List the records already available and the gaps. Keep operating-company facts separate from the proposed Canadian business.

  5. Review the personal timeline

Put immigration status, intended activities and commercial commitments on the same page. Seek advice before relying on an assumed future opening.

  6. Decide what happens next

Proceed, revise, wait or abandon the proposal after the assessment. This process does not end in a promised permit or permanent residence decision.

Use the Program Status Board to begin your intake check and the plain-language terms below to keep the different decisions separate.

Which business immigration applications are open in 2026?

There is no single business immigration application that every entrepreneur can use. Start with intake, then examine the category’s purpose and your evidence. “Open” means there are current instructions under which an application may be considered; it does not mean you qualify or that an application will be approved.

Intake and scope checked October 19, 2026; not a personal eligibility assessment
Category Current position What to check next
Start-Up Visa permanent residence New intake paused; accepted files continue Whether a file was accepted before the pause
Federal Self-Employed Persons Program Intake paused until further notice Existing-file instructions, not a presumed reopening
C11 business-owner work permit Temporary-purpose instructions exist Purpose, benefit, funds and evidence
Intra-company transfer Category-specific instructions exist Company relationship, role and applicable rules
LMIA-supported employment Employer requirements apply Genuine employment and the correct wage stream
Provincial nomination Province and stream must be checked separately Actual intake, settlement intention and criteria

Use the table as a sorting tool, not a recommendation to apply to every category. A proposed purchase, a transfer within an existing group and a temporary owner-operated project raise different questions. Write the facts first so the category is chosen for the activity rather than the activity being rewritten to fit an attractive label.

What happened to the Start-Up Visa filing window?

Ministerial Instructions 90 took effect on January 1, 2026 and paused new applications subject to an exception for valid 2025 commitments. The current designated-organisation guidance says those applicants had to apply by June 30, 2026. The current public program page now states that new applications are not being accepted.

For a new applicant, a support proposal is not evidence that the expired filing window can be used today. For someone with an accepted application, the relevant task is different: review the existing file and any requests or changes that need attention. Keep proof of what was submitted and the government’s correspondence together.

Check the work-permit question separately. The optional Start-Up Visa work-permit page is closed to new applicants from December 19, 2025, while existing permit holders may be able to extend during permanent residence processing. Do not assume a permanent residence filing or a support letter gives a new applicant that work permit.

Does self-employment qualify for the federal Self-Employed Persons Program?

The federal Self-Employed Persons Program is paused and concerns cultural or athletic experience and contribution. Its name does not mean every consultant, shop owner or independent contractor has a federal permanent residence category. The original pause announcement set April 30, 2024 as the intake-pause start date; the later ministerial instructions extend the pause until further notice.

If an old article presents a fixed reopening date, compare it with the current notice before relying on it. Keep the date of the source beside the claim in your planning record. A historical announcement can explain how a rule changed without being the correct instruction for a new application now.

Has the announced entrepreneur pilot opened?

IRCC’s December19,2025 notice discussed a targeted entrepreneur pilot. The September4,2026 departmental briefing also names work towards a High Impact Start-up Pilot. A briefing about planned policy is not an application-opening instruction. Before relying on a new route, verify its actual current intake page, eligibility rules and application process; this overview does not present proposed criteria as available.

Do not enter a proposed launch date, investment threshold or eligibility promise into a business plan unless it can be matched to the actual published program instructions. Keep any new announcement in a separate “to verify” column until its application process is clear. An announcement about policy direction and an invitation to file an application are different records.

Check the category before committing to a purchase

Bring the current government notice, company structure and proposed Canadian activities to a consultation. Advice is separate from representation; further work requires a written retainer.

When should a business owner examine C11?

IRCC’s C11 instructions address certain business owners seeking only temporary residence to run, including establish, their business. They require a temporary purpose, significant Canadian benefit and personal support funds separate from business funds. An applicant must demonstrate the case with supporting evidence; merely incorporating or buying shares does not answer those requirements.

For an initial discussion, describe what work you personally intend to do, why your presence is needed and what happens when the temporary project ends. Identify which funds support your family and which are available to the business. Those are preparation questions, not a substitute checklist for a complete application.

This status guide deliberately does not repeat the full evidence analysis. The site’s C11 significant-benefit evidence guide is the place to examine that subject in more detail. Use a focused guide after confirming that the category’s purpose matches the proposed activity.

Can an owner transfer from a company abroad?

The general intra-company transfer instructions require a qualifying multinational-enterprise relationship and an eligible role. Establishing a new Canadian enterprise under C61 has a specific existing-multinational test. A foreign company with a new Canadian incorporation should not assume that the paperwork alone creates eligibility.

Record where each company actually operates, which entity employs the applicant and how the entities are connected. Distinguish an operating relationship from a planned commercial relationship. Where a trade agreement may apply, its rules need separate consideration rather than being mixed with the general category.

Read the intra-company transfer work-permit guide for the detailed company and role questions. Keeping this overview focused on selecting the correct investigation avoids giving you several overlapping checklists with different assumptions.

Is an LMIA a business-owner shortcut?

Do not treat an LMIA as an exemption from employer scrutiny. ESDC’s high-wage requirements assess the employer-employee relationship, business legitimacy and recruitment, among other requirements. They say employers will not be approved where the necessary employer-employee relationship does not exist.

Describe the real arrangement: who directs the work, pays the wages and can end employment. Ask for advice on the applicable program before presenting a self-employment proposal as employment. This guide does not conclude that an owner-controlled arrangement is eligible and does not recommend a business purchase to obtain an LMIA.

What about Ontario and other provinces?

The Provincial Nominee Program overview confirms that provinces and territories have their own requirements and that applicants must intend to live in the nominating province or territory. A general nomination page is not evidence that a specific entrepreneur stream is accepting applications. Check the current provincial intake notice and the exact stream before making a commercial commitment.

Ontario’s current OINP overview says that the Workforce Priority stream has launched and all other streams are closed. Do not read an old Entrepreneur Stream guide as an invitation to apply. The overview does not determine how an individual historical entrepreneur file is treated; use the applicable current instructions and the correspondence for that file.

For another province, record the intended community, the stream’s current intake and the sequence described in its own instructions. Avoid building a plan around a province where you do not intend to live. A commercial preference and an immigration settlement intention should be discussed together rather than kept in separate versions of the proposal.

How do visits, work and permanent residence differ?

The business-visitor instructions distinguish a visit from entering the Canadian labour market. Meetings and a proposed role operating a Canadian business should not be described as the same activity. State what you will actually do in Canada when checking the correct permission.

A permanent residence assessment is also separate from a business work permit. The Canadian Experience Class page excludes self-employed work experience, with a particular exception for some physicians. Do not assume that time operating your own company creates qualifying CEC experience. The CEC work-experience guide explains the evidence questions for that separate assessment.

IRCC and the responsible provincial and federal authorities decide applications. A commercial agreement cannot bind that decision. Keep the proposed business decision, immigration application and personal fallback plan distinct in the advice you seek.

Put the proposal and the rule on the same page

This blank editorial organiser is not a government form, a client example or a statement about Progressive’s internal procedures. Complete it privately with facts and questions, without inventing evidence to fill a blank.

A business-immigration planning record
Field What to record
Actual goal Visit, temporary work or permanent residence; list separate goals separately.
Business facts Existing operations, ownership, your role and the proposed Canadian activities.
Current instruction Exact government URL, date checked, intake status and the rule being considered.
Evidence and gap Record available, fact it supports and a question that still needs an answer.
Commitment and fallback Any proposed purchase, lease or timing dependency, and what you will ask before committing.

Keep the original source separate from your notes so a later update is visible. If the official page changes, record the new date and ask which part of the proposal needs reconsideration. Do not silently replace the old assumption and lose the reason for the change.

Questions about business immigration status

Can I make a new Start-Up Visa application now?

The public page checked October 19, 2026 says new applications are not being accepted. The valid-2025-commitment filing window ended June 30, 2026. Existing accepted applications are a separate issue.

Does buying a Canadian business give me permanent residence?

A purchase does not establish immigration eligibility. Identify the applicable category, current intake and personal requirements before making a commercial commitment.

Can a business visitor operate the Canadian business?

Business-visitor status has conditions, including not entering the Canadian labour market. Check the actual proposed activities against IRCC’s instructions; work may require a work permit.

Does C11 automatically lead to the Canadian Experience Class?

No. A business work permit and permanent residence eligibility are separate assessments. The CEC page excludes self-employed work experience, with a specific exception for some physicians.

What should you bring to a first discussion?

Bring the current notice you relied on, a factual company chart and a plain description of your proposed work. Add existing immigration documents, relevant government correspondence and the proposed dates of any commercial commitment. Keep unresolved questions visible instead of presenting them as settled parts of the plan.

If you already filed an application, bring the actual submission and response records rather than only the business plan used at the start. If you have not filed, say that clearly. The advice needed for an accepted file, a new temporary project and an unavailable intake is different.

Request a consultation to assess those questions; representation requires a separate written retainer.

Business immigration terms to keep separate

Temporary work permission
Permission to do the work described by the applicable rules and conditions. It does not itself grant permanent residence.
Provincial nomination
A province or territory assesses its own nomination requirements. A nomination and the later federal permanent residence assessment are separate steps.
Intake status
Whether a program is currently accepting the relevant type of application. Published eligibility information does not override a pause or filing deadline.

For existing federal files, see our Start-Up Visa program page. A new temporary business proposal needs a separate assessment.

Employer work permits: IRCC job-offer fairness letters

IRCC can ask for more evidence when it doubts that an employer-specific job offer is genuine. Read the actual letter before responding: its concerns, deadline and delivery instructions matter. A letter gives an opportunity to answer concerns; it does not promise a work permit.
